These Terms of Service (“Terms”) govern your access to and use of soundadviceinstruments.com, including any software, plugins, sample libraries, presets, updates, accounts, and related services (the “Services”) offered by Sound Advice Instruments (“we,” “us,” or “our”).
By browsing the site, creating an account, or completing a purchase, you agree to these Terms. If you do not agree, do not use the Services.
1. Who may use the Services
You must be at least 18 years old, or the age of majority in your location, and able to form a binding contract. If you buy or use the software for a company, you represent that you have authority to bind that company.
2. Accounts
You are responsible for your account credentials and for all activity under your account. Keep your login, license keys, and download links confidential. Email support@soundadviceinstruments.com if you believe your account was used without permission.
We may refuse, suspend, or close an account if we reasonably believe these Terms were violated, a payment was fraudulent, or the software was shared or reverse-engineered.
3. Products and license (not a sale of ownership)
Our plugins, instruments, effects, libraries, presets, and related files are licensed, not sold. Sound Advice Instruments and its licensors keep all ownership, copyright, trademark, and other intellectual-property rights.
Unless your product page or license certificate says otherwise, a standard purchase grants you a limited, non-exclusive, non-transferable, perpetual license to:
- install and use the software on computers you own or control, for the number of seats stated at checkout (if none is stated, one user / a reasonable number of your own machines);
- use the software to create and commercially release your own music, recordings, and other original works.
You may not:
- share, rent, sublicense, resell, or publicly post the installer, serial, license file, or library content;
- reverse engineer, decompile, or bypass copy protection, except where a law expressly allows it;
- use our trademarks, product names, or logos to imply we endorse your release;
- redistribute our samples, presets, or factory content as a competing library, pack, or standalone product.
Demo or NFR (not-for-resale) copies are for evaluation or authorized promotional use only and may not be used in commercial releases unless we say otherwise in writing.
4. Compatibility
Formats (for example VST3, AU, AAX), supported DAWs, operating systems, and system requirements are described on the product page at the time of purchase. We do not guarantee that the software will run in every host, OS version, or future DAW update. You are responsible for confirming compatibility before you buy.
5. Orders, taxes, and delivery
Prices are shown at checkout and may change at any time before you pay. Digital products are delivered by download, license key, or account unlock after payment clears. You are responsible for a working internet connection, a compatible computer, and any sales tax, VAT, or duties that apply.
If delivery fails because of a problem on our side, contact support@soundadviceinstruments.com and we will replace the download or license.
6. Refunds
Because this is licensed digital software, sales are generally final once the license is issued or the files are downloaded.
We may, at our discretion, refund or replace a purchase if:
- the product is materially not as described;
- a technical defect we cannot reasonably fix prevents use on a supported system;
- you request a refund within 14 days of purchase and you have not redeemed, activated, or downloaded the product (or you deactivate the license if we ask).
Chargebacks filed without first contacting us may result in license revocation and account closure.
7. Updates and changes
We may provide updates, bug fixes, or new builds. We do not promise ongoing updates, a specific support window, or compatibility with future operating systems or DAWs. We may change, pause, or discontinue a product or the site with reasonable notice where practical.
8. Third-party services
Checkout, license activation, cloud backups, analytics, or email tools may be provided by third parties (for example payment processors). Their terms apply to those services. We are not responsible for third-party outages or policy changes.
9. Acceptable use
You may not use the site or software to break the law, infringe others’ rights, distribute malware, scrape the site in an abusive way, attack our licensing systems, or interfere with other customers.
10. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH EVERY SYSTEM.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUND ADVICE INSTRUMENTS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST RECORDINGS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM.
SOME PLACES DO NOT ALLOW CERTAIN LIMITATIONS. IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.
12. Indemnity
You will defend and indemnify Sound Advice Instruments against claims arising from your misuse of the software, your content or releases, your violation of these Terms, or your infringement of someone else’s rights.
13. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms. On termination of a license for cause, you must delete the software and any copies. Sections that by nature should survive (including license restrictions, IP, disclaimers, liability limits, and governing law) remain in effect.
14. Privacy
Our Privacy Policy explains how we collect and use personal information.
15. Changes to these Terms
We may update these Terms by posting a new version on this page and changing the “Last updated” date. Continued use after the change means you accept the updated Terms. For material changes, we will try to give reasonable notice.
16. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Courts located in California will have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect intellectual property or licensing systems.
